1. These terms

These terms apply to work carried out by Delpeche Ductwork Installations Ltd for ductwork and ventilation systems — installation, replacement, modification, and the adjustments and checks that go with them.

By accepting a quote from us you accept these terms. If anything in them does not match what you have been told in writing, the written quote takes priority.

2. Surveys and quotes

Work is quoted after a survey of the space, against the route, the duct sizes and the components the job needs. A quote is valid for the period stated on it.

Where the scope changes because of something only discoverable once work has started, we tell you before doing the extra work and agree it with you first.

3. Orders and when a contract starts

The contract between us starts when you accept our quote in writing. We begin ordering materials and scheduling work from that point.

A quote can be withdrawn if materials or access arrangements change materially before it is accepted.

4. Access and site conditions

You agree to provide safe access to the areas where work is needed, including where work is carried out at height.

• Access arranged for the agreed working times
• Any known hazard on site made known to us before work starts
• Where possible, furniture and finishes moved clear of the working area

5. Changes and cancellation

Changes to agreed work must be agreed in writing before they are carried out. We will confirm any effect the change has on the figure and on the schedule.

If you cancel after materials have been ordered or cut, you are responsible for the cost of the materials and work already committed to.

6. Payment

Payment terms are set out on the quote. Unless stated otherwise, materials ordered specifically for the job and work already carried out are payable.

Ownership of materials passes to you on payment in full.

7. Our responsibility to you

We carry out work with reasonable skill and care, and to the scope set out in the quote. If something we have installed does not meet that standard, we will put it right.

8. Limits on liability

We are responsible for the work we carry out. We are not responsible for loss arising from pre-existing defects in the building, from work carried out by others, or from the existing system being unsuitable in ways that were not reasonably discoverable at survey.

9. Governing law

These terms are governed by German law, and any dispute falls to the courts of Germany.
